IMPORTANT INFORMATION ABOUT YOUR RENTALS

On arrival you will be required to sign a rental agreement with the operators of Wilderness Motorhomes. Here is a summary of their terms and conditions.

DEFINITIONS

The following definitions apply for the Terms and Conditions of Wilderness Motorhomes:

 * The Supplier means the operator of Wilderness Motorhomes.
 * The Client is also referred to as the hirer (s) or renter (s).

This agreement is between the rental vehicle operator (the “Operator”) and the hirer whose particulars are recorded in this agreement (the Hirer”). It is hereby agreed that:

PAYMENTS BY HIRER
1. * A deposit is due upon confirmation, as stipulated in your payment breakdown. This is non-refundable and will be collected using your nominated credit card provided.
* The balance amount shown, is due 35 days prior to the pick up date.You will be sent an email request/reminder, with a link to a secure site where you can process your payment.
* A bond amount is due when you pick up the vehicle (and is payable whether you have taken out an excess reduction policy or not).
* Extensions are subject to availability and are calculated at the daily rental rate on the date booked.
* Please read the full Terms and Conditions for full details of each element of the Payment Terms.

SPECIAL PAYMENT TERMS
* Full payment will be collected (deposit AND balance amount) at the time of confirmation, if you have elected to process your booking in a currency other than NZD.

Please note: If the balance is not received 35 days prior to commencement of the hire, the Operator reserves the right to treat the booking as canceled. If the term of hire is later extended the Hirer shall pay the Operator for the additional hire period when the Operator confirms the extended period.

CANCELLATION OF HIRE AGREEMENT
2. The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
If the Hirer cancels the hire agreement:
  • 38 days or less prior to pickup then a cancellation fee of 20% of the total hire cost applies;
  • less than 23 days prior to pickup then a cancellation fee of 50% of the total hire cost applies;
  • less than 10 days prior to or on the day of pick up then no refund will be given.
If the Hirer reduces the length of hire once a booking has been made then an amendment fee of 50% of the hire cost for the cancelled days applies if the amendment is made less than 23 days prior to pick up; less than 10 days prior to or on the day of pick up then no refund will be given for the cancelled days. If the Hirer amends the pick up date less than 35 days prior to pick up to a date later than the original drop off date
then an amendment fee of NZ$250 applies.

Travel insurance
We strongly recommend that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.

3. The Operator may cancel the hire agreement and take immediate possession of the Vehicle if:
* The Hirer fails to comply with any of the terms of this agreement or if the Vehicle is damaged.
* The Hirer has obtained the Vehicle through fraud or misrepresentation.
* The Vehicle appears to be abandoned.
* The Vehicle is not returned at or before the expiry of the term of hire or the Operator reasonably believes that the Vehicle will not be returned at or before the expiry of the term of hire.
* The Operator considers, on reasonable grounds that the safety of the passengers or the condition of the Vehicle is or has been endangered.

4. If the Operator cancels the hire agreement then no refund will be given.

5. The termination of the hiring under the authority of this clause shall be without prejudice to the other rights of the Operator and the rights of the Hirer under this agreement.

6. Terms and conditions as well as rates quoted are subject to change without notice. However, rates or conditions for a particular booking shall not be altered once that booking has been confirmed.

7. In addition, the Hirer acknowledges that s/he shall be liable to pay to the Operator at the end of the hire period any applicable additional charges specified in the agreement. These may include Road User Charge Recovery Fee(This fee is charged at exactly the same rate as the government charges us:Darts: $4.85 per 100km; Nuggets, Base Jumpers, and Ixeo: $5.13 per 100km ; Longboarders: $5.30 per 100km ) ,charges for fuel, late return, damage to or repair of the vehicle (subject to other terms in this agreement), costs incurred for the Operator through salvage or loss of revenue resulting from the hire, any enforcement charges relating to such damage or repairs (including legal costs), traffic fines or infringement fees, and toll charges and the administration costs relating to these fines, fees, and charges. The Operator will deduct such charges from the Hirer's credit card during or after the term of hire is completed, or the Hirer may pay such charges as agreed with the Operator, such choice to be at the Operator’s sole discretion. 

8. All payments shall be made in New Zealand dollars at the New Zealand currency rate on the day payment is made. The following
credit or debit cards will be accepted: Visa and Mastercard. A nonrefundable 2% administration fee will apply to all bank card transactions.

9. Rates include GST. Rental days are calculated on a calendar basis. Part days at the start or end of the hire are charged at the full daily rate. The day of pick-up is counted as day one of the hire period regardless of the pick-up time. The day the Vehicle is returned is counted as the final day of the rental regardless of return time. If your intended travel dates cross two different rate periods, your rental will be based on the number of days of hire in each period.

10. Late pick up or early return of the Vehicle shall not entitle the Hirer to any refund of the unused portion of the rental.

11. The Hirer agrees to pay a bond equal to the applicable insurance excess at the start of the hire which will be refunded once the Vehicle and its contents have been returned in the same condition as when hired and the Vehicle is returned to the agreed location on the agreed date. The bond will be reduced rateably and proportionally to allow the Operator to put the Vehicle and/or its contents back in the same condition it was when it was hired.

12. On payment of liability reduction insurance by the Hirer, the bond payable by the Hirer is reduced to NZ$500. The bond is taken in the form of a credit card authorisation (we do not take a cash bond or hold money on your credit card).

INSURANCE
13. Any driver described in this agreement as a person permitted to drive the Vehicle is, subject to the exclusions set out below, covered against any loss or damage to the Vehicle and for any consequential damage, loss or costs incurred by the Operator through salvage or loss of revenue resulting from the hire beyond the applicable excess amount.

14. Any driver described in this agreement as a person permitted to drive the Vehicle is, subject to the exclusions set out below, is indemnified to the extent of NZ$1,000,000 in respect of any liability he or she might have for damage to any property (including injury to any animal) belonging to any person and arising out of the use of the Vehicle.

15.The Hirer's liability will be for any loss or damage to the Vehicle, however caused, and for any consequential loss or damage, during the term of this hire, or during any authorized extensions to the term up to the applicable excess amount.

16. The excess payable by the Hirer is either NZ$2500 or NZ$5000 depending on the Vehicle type in the case of damage to, or accidents involving the Vehicle when the Hirer has not taken liability reduction insurance.On payment of the liability reduction insurance by the Hirer, the excess payable by the Hirer is reduced or eliminated depending on the liability reduction option selected and subject to exclusions in clause 19.

17. In the event of any damage to a Vehicle or third party property, another bond shall be collected to cover the excess for any subsequent damage.

18. Where the total cost of a claim is less than the excess then the Hirer shall be liable to pay that lesser amount.

INSURANCE EXCLUSIONS
19. The Hirer acknowledges that the cover referred to in clause 13 will not apply when:
* the Vehicle is driven by anyone not named or described in this agreement as a person permitted to drive the Vehicle;
* the driver of the Vehicle is under the influence of alcohol or any drug;
* the Vehicle is in an unsafe or unroadworthy condition, such condition arising during the course of the hire, that caused or contributed to the damage or loss, and the Hirer or driver was aware or should have been aware of the unsafe or unroadworthy condition of the Vehicle;
* the Vehicle is wilfully or recklessly damaged or lost by the Hirer, a nominated driver, or a person under the Hirer's authority or control including sitting or standing on the roof, driving on any beach or surface likely to damage the Vehicle, driving through flooded areas, submersing in water, contacting salt water; 
* the Vehicle was operated outside the terms of this agreement or any agreed extension of this agreement.

VEHICLE DESCRIPTION AND TERM OF HIRE
20. The Operator will let and the Hirer will take the vehicle, details of which are set out the "Vehicle" of this agreement, for the term of hire described in this agreement.

PERSONS WHO MAY DRIVE VEHICLE
21. The Vehicle may be driven during the term of hire only by the persons described in this agreement and only if each such person holds a current full driver's licence appropriate for the class of vehicle in this agreement and is aged 21 or over. The licence details are recorded in the agreement alongside each person's name. If the foreign driver's licence is not in English, an English translation or international driving permit shall be carried with the foreign driver's licence.

USE OF THE VEHICLE
22. The Hirer shall not:
* Sublet or hire the Vehicle to any other person;
* Allow the Vehicle to be used outside his/her authority;
* Operate the Vehicle, or permit it to be operated in circumstances that constitute an offence;
* Drive or allow the Vehicle to be driven on any beach or surface likely to damage the Vehicle; or
* Involve the Vehicle in any race, speed test, rally or contest
* Operate the Vehicle or allow it to be operated for the transport of more persons than is permitted by any relevant authority or detailed in the Vehicle Manual.

OPERATOR'S OBLIGATIONS
23. The Operator shall supply the Vehicle in a safe and roadworthy condition, up to the current Certificate of Fitness standards.

24. The Operator shall be responsible for all ordinary and extraordinary costs of running the Vehicle during the term of the hire except to the extent that by the terms of this agreement those costs are payable by the Hirer.

25. If the reserved Vehicle is not available for reasons outside the Operator’s control, then the reserved Vehicle may be substituted with a comparable or superior Vehicle at no extra cost to the Hirer.  Such Vehicle substitution shall not constitute a breach of contract and does not entitle the Hirer to any form of refund. If no substitute Vehicle is available to the Hirer, the Operator’s liability shall be limited to a refund of the hire charge in full.  In the case of mechanical failure (unless caused by the Hirer), the Operator’s liability shall be limited to the hire charge for the remainder of the term of hire. 

HIRER'S OBLIGATIONS
26. The Hirer shall ensure that:
* All reasonable care is taken when driving and parking the Vehicle;
* The engine coolant and oil in the Vehicle are maintained at the proper level;
* The tyres are maintained at their proper pressure;
* The Vehicle is locked and secure at all time when it is not in use;
*  The Vehicle keys are kept secure. The cost of replacement keys (approximately NZ$500) and related services for example courier is at the Hirer's expense;
* No part of the engine, transmission, braking or suspension systems are interfered with;
* The fuel tanks are filled with the correct fuel and the freshwater tanks are not contaminated. The cost of draining and decontaminating tanks is at the Hirer's expense;
* Should a warning light be illuminated or the Hirer believes the Vehicle requires mechanical attention, s/he stops driving and advises the Operator immediately;
* There is no smoking in the Vehicle. Any evidence of smoking in the Vehicle shall incur a cleaning fee of NZ$500; and
* Animals, except for registered guide dogs, are not permitted inside the Vehicle.

MECHANICAL REPAIRS AND ACCIDENTS
27. If the Vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the Hirer shall notify the Operator of the full circumstances within 24 hours or as soon as practicable in order to give the Operator the opportunity to rectify the problem during the rental. Failure to do so may affect any claims for compensation.

28. The Hirer shall not arrange or undertake any repairs or salvage without the Operator's authority except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property. If the Vehicle is damaged to the extent that it cannot be driven, the Operator shall endeavour to exchange the Vehicle. Provision of an exchange vehicle is subject to availability and Hirer's location. 

29. The Operator's liability extends only to the refund of hire charges for any full days of Vehicle use lost due to a mechanical breakdown. No responsibility for out of pocket expenses, accommodation charges or meals resulting from a breakdown or accident will be accepted.

30. All Vehicles are registered with the Automobile Association (AA) for 24hr roadside assistance. This service covers any mechanical faults with the Vehicle. Please note that the AA does not cover the following and the associated costs will be the responsibility of the Hirer: 
*  the Vehicle running out of fuel; 
*  keys being locked inside the Vehicle or lost; 
*  flat batteries caused by incorrect usage of the batteries and/or incorrect usage of any equipment that requires the batteries in order to operate; and 
*  a breakdown as a result of damage caused in an accident. 

31. All AA non-mechanical call-outs will incur a call-out charge of NZ$85 plus GST.

VEHICLE COLLECTION AND DROP OFF INSTRUCTIONS

Vehicle collection and drop off times: 08:00 - 16:00 Monday to Sunday

An after hours vehicle collection service is available from 16:01 to 18:30 (Monday to Sunday) for a surcharge of NZ$50.

Complimentary transfers are available to and from the depot and the airport or airport area hotels.
NOTE: when using the transfer service for vehicle collection your flight arrival time must be no later than 17:30 (Monday to Sunday). Customers must ensure that they have taken this into account before confirmation.

RETURN OF THE VEHICLE
32. The Hirer shall, at or before the expiry of the term of hire, deliver the Vehicle to the Operator as shown on the front of this agreement, or obtain the Operator's consent to the continuation of the hire. Any alteration to the place the Vehicle is returned to may be subject to a charge of up to NZ$1000. Failure to return the Vehicle at the agreed time and/or day will incur a late fee of NZ$150 per day payable in addition to the daily rental rate for each day until the Vehicle is returned.

33. The Hirer shall return the Vehicle with
*  a full diesel tank and full LPG bottles. Failure to do so shall result in refill charges of fuel cost plus NZ$50;
* empty waste tanks;
* all Vehicle equipment accounted for and undamaged. The Hirer is liable for any equipment that is damaged or not accounted for;
* In a reasonably clean and tidy condition. Failure to do so shall result in a cleaning fee of up to NZ$250.

TRAFFIC AND CAMPING OFFENCES
34. The Hirer is advised that New Zealand law permits the Operator to debit the Hirer's credit card for any infringement fee for an offence where the offence was committed during the term of the hire. These include speeding, toll road, parking and freedom camping offences.  The Operator may also charge an administration fee of NZ$25 per infringement notice received.

35. The Operator will send the Hirer a copy of the infringement notice and any reminder notice as soon as practicable after it is received by the Operator.  The Hirer has the right to challenge, complain about, query or object to the alleged offence to the issuing enforcement authority and seek a court hearing (within 56 days from the date of issue of the infringement notice or 28 days from the date of issue of the reminder notice)

INDEMNITY
35. The Hirer releases the Operator and its employees and agents from any liability to the Hirer (regardless of who is at fault) for any loss or damage incurred by the Hirer by reason of rental, possession or use of the Vehicle.

Note to Hirer
The Operator must give you at least one copy of this agreement. A copy must be kept in the Vehicle throughout the term of the hire and be produced on demand by any law enforcement officer.

Liability

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.95% credit card or debit card surcharge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Motorhome rental alterations (all charges stated in local currency): 25.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.

INSURANCE
1. Any driver described in this agreement as a person permitted to drive the Vehicle is, subject to the exclusions set out below, covered against any loss or damage to the Vehicle and for any consequential damage, loss or costs incurred by the Operator through salvage or loss of revenue resulting from the hire beyond the applicable excess amount.

2. Any driver described in this agreement as a person permitted to drive the Vehicle is, subject to the exclusions set out below, is indemnified to the extent of NZ$1,000,000 in respect of any liability he or she might have for damage to any property (including injury to any animal) belonging to any person and arising out of the use of the Vehicle.

3.The Hirer's liability will be for any loss or damage to the Vehicle, however caused, and for any consequential loss or damage, during the term of this hire, or during any authorized extensions to the term up to the applicable excess amount.

4. The excess payable by the Hirer is either NZ$2500 or NZ$5000 depending on the Vehicle type in the case of damage to, or accidents involving the Vehicle when the Hirer has not taken liability reduction insurance .

On payment of the liability reduction insurance by the Hirer, the excess payable by the Hirer is eliminated subject to exclusions in clause 7.

5. In the event of any damage to a Vehicle or third party property, another bond shall be collected to cover the excess for any subsequent damage.

6. Where the total cost of a claim is less than the excess then the Hirer shall be liable to pay that lesser amount.

INSURANCE EXCLUSIONS
7. The Hirer acknowledges that the cover referred to in clause 1 will not apply when:
* the Vehicle is driven by anyone not named or described in this agreement as a person permitted to drive the Vehicle;
* the driver of the Vehicle is under the influence of alcohol or any drug;
* the Vehicle is in an unsafe or unroadworthy condition, such condition arising during the course of the hire, that caused or contributed to the damage or loss, and the Hirer or driver was aware or should have been aware of the unsafe or unroadworthy condition of the Vehicle;
* the Vehicle is wilfully or recklessly damaged or lost by the Hirer, a nominated driver, or a person under the Hirer's authority or control including sitting or standing on the roof, driving on any beach or surface likely to damage the Vehicle, driving through flooded areas, submersing in water, contacting salt water; 
* the Vehicle was operated outside the terms of this agreement or any agreed extension of this agreement.

The supplier's depot is near the airport (approximately 10 minute drive) and they provide a complimentary transfer service to it from Auckland Airport or airport area hotels. You are also welcome to make your own way, at your own expense, to the depot.

Once at the depot, the supplier will brief you on the camper before you depart on your hire.


Complimentary transfer service
The supplier provides complimentary transfers to their depot from Auckland Airport or airport area hotels. Please advise if you require the transfer service, well in advance of your vehicle collection date.

The transfer service is available from 08:00 each day (Monday to Sunday) but please note that your flight must arrive by 17:30 at the latest in order to take advantage of this service and collect your vehicle.

From the Arrivals Hall (at Auckland Airport) please go to the nearest telephone and call the freephone number supplied.  Once you have confirmed your arrival the operator will send a courtesy vehicle to pick you up and bring you back to the depot for the collection of your camper.  The operator will tell you where to wait for the courtesy vehicle.

If the transfer service is not appropriate for you, then please do make your own way to the depot to collect your motorhome.

Standard vehicle drop off hours are: Monday - Sunday 08:00 to 16:00

The supplier provides complimentary transfers from their depot to the airport or airport hotels.

If the transfer service is not appropriate for you or if you chose to stay at a city centre hotel, then the supplier can arrange a taxi (at your own expense) for you.
